DPP to appeal high court drink driving judgement

The DPP has asked the court of appeal for permission to appeal the High Court decision of Mr. Justice Seamus Noonan after he ruled that Mihai Avadenei a Romanian national, should have been given a print-out of his breath test reading in both Irish and in English. The ruling said that a Breath Alcohol Test Statement is not a valid piece of evidence if it is only printed in English. In the interim the DPP Claire Loftus has asked Gardai to seek adjournments in all affected drink driving cases pending theoutcome of the appeal. However, some District Court judges are taking the view that the decision of Mr. Justice Noonan is the law currently and are striking out drink driving cases where breath test statements were not printed in both languages.
